Terms & Conditions

General

By placing an order with Kreations By Merr, the customer agrees to the following Terms & Conditions. These terms apply to all orders, quotes, invoices, and services provided.

Orders & Deposits

• A minimum 50% non-refundable deposit is required before production begins.
• Orders are not scheduled or started until deposit is received.
• Remaining balance must be paid in full before pickup or shipping.
• Failure to complete payment may result in order cancellation without refund of deposit.

Custom Work Policy

All embroidery and decorated apparel are custom-made.

Due to the custom nature of our services:

• All sales are final once production has begun.
• No refunds or exchanges will be issued on custom items.

Artwork & Intellectual Property

By submitting artwork, logos, or designs, the customer confirms that:

They own the rights to the artwork OR
They have authorization to reproduce the artwork
Customer agrees to indemnify, defend, and hold harmless Kreations By Merr from any trademark, copyright, or intellectual property claims arising from submitted artwork.

Proof Approval

• A digital mockup/proof will be provided before production.
• Production begins only after written approval (email or message confirmation).
• Customer is responsible for verifying spelling, size, placement, and colors before approval.

Once approved, Kreations By Merr is not responsible for errors that were present in the approved proof.

Customer-Supplied Garments

If customer provides their own garments:

• We are not responsible for pre-existing manufacturer defects.
• We take care to minimize risks, but limited damage may occur during embroidery (needle breaks, tension issues, minor snags).
• If damage occurs due to our error, we will repair or redo the embroidery or offer a credit/refund for the embroidery service.
• Replacement of the garment itself is not guaranteed.

Turnaround Time

• Estimated production time is approximately 2 weeks from the date of deposit payment and proof approval.
• This is an estimate only and is not guaranteed.
• Production timelines may vary due to order volume, material availability, or unforeseen circumstances.
• Rush orders may be subject to additional fees.

Product Variations

• Slight variations in thread color, garment shade, or placement may occur.
• These variations are considered normal in custom production and are not considered defects.

Shipping & Pickup

• Customer is responsible for providing correct shipping information.
• We are not responsible for delays or damage caused by shipping carriers.
• Orders not picked up within 30 days may be subject to storage fees.

Limitation of Liability

To the fullest extent permitted by law, Kreations By Merr shall not be liable for:

• Indirect or consequential damages
• Loss of profits
• Business interruption
• Third-party claims related to customer-provided materials

Total liability shall not exceed the total amount paid for the order.

Chargebacks & Payment Disputes

Initiating a chargeback without contacting us first to resolve an issue may result in:

• Immediate cancellation of future services
• Submission of proof of approval and documentation to payment processors

Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts.
